This article critically evaluates the possible impact of the Charter on the relationship between the Court of Justice of the European Union and national constitutional courts. While it is premature to provide a definitive assessment of the kind of collaboration that these courts will develop, it is crucial to identify a number of features of the new landscape that will influence the direction in which the relationship between the CJEU and constitutional courts will evolve. This article discusses several reasons that (...) may result in better or a higher number of judicial interactions, as well as factors that may create tension or cause problems in the relationship between the CJEU and national constitutional courts. As such, it offers a framework that may help us to understand future post-Charter judgments by these courts setting out how they conceive their engagement with their counterpart on fundamental rights issues. The widespread potential for somatic fusion among different conspecific multicellular individuals suggests that such fusion is adaptive. However, because recognition of non‐kin (allorecognition) usually leads to a rejection response, successful somatic fusion is limited to close kin. This is consistent with kin‐selection theory, which predicts that the potential cost of fusion and the potential for somatic parasitism decrease with increasing relatedness. Paradoxically, however, Crozier1 found that, in the short term, positive‐frequency‐dependent selection eliminates the required genetic polymorphism at allorecognition loci. The (...) ‘Crozier paradox’ may be solved if allorecognition is based on extrinsically balanced polymorphisms, for example at immune loci. Alternatively, the assumption of most models that self fusion is mutually beneficial is wrong. If fusion is on average harmful, selection will promote unconditional rejection. However, we propose that fusion within individuals is beneficial, selecting for the ability to fuse, but fusion between individuals on average costly, selecting for non‐self recognition (rather than non‐kin recognition). The anticipated social capabilities of robots may allow them to serve in authority roles as part of human-machine teams. To date, it is unclear if, and to what extent, human team members will comply with requests from their robotic teammates, and how such compliance compares to requests from human teammates. This research examined how the human-likeness and physical embodiment of a robot affect compliance to a robot's request to perseverate utilizing a novel task paradigm. Across a set of two studies, (...) participants performed a visual search task while receiving ambiguous performance feedback. Compliance was evaluated when the participant requested to stop the task and the coach urged the participant to keep practicing multiple times. In the first study, the coach was either physically co-located with the participant or located remotely via a live-video. Coach type varied in human-likeness and included either a real human, a Nao robot, or a modified Roomba robot. The second study expanded on the first by including a Baxter robot as a coach and replicated the findings in a different sample population with a strict chain of command culture. Results from both studies showed that participants comply with the requests of a robot for up to 11 min. Compliance is less than to a human and embodiment and human-likeness on had weak effects on compliance. (shrink)

Sexually active male haplochromine cichlid fishes possess pronounced yellow ovoid spots on the anal fm, which mimic eggs of the female and have therefore been called egg dummies (Wickler, 1962b).It is thought that divergence in egg dummy characteristics can considerably reduce gene flow and in this way may trigger off reproductive isolation. There has been much talk of the need to build intermediate models of the expertise required preparatory to constructing a knowledge-based system in the legal domain. Such models offer advantages for verification, validation, maintenance and reuse. As yet, however, few such models have been reported at a useful level of detail. In this paper we describe a method for conceptualising legal domains as well as its application to a substantial fragment of the Dutch Unemployment Benefits Act (DUBA).We first discuss the (...) intermediate models (called expertise models), then present a three-stage method for their construction, drawing on the CommonKADS work in knowledge acquisition, conceptual models of statute law, and the KANT method of knowledge analysis. Subsequently, we describe how these techniques were applied to the DUBA, and provide detailed examples of the resulting model. Finally, conclusions on the framework and guidelines are given as well as means of recording and presenting the various design choices. (shrink)

Classroom discussion is frequently proposes as an essential part of democratic citizenship education. Literature, however, pays little attention to what kind of discussion is most effective and how teachers can facilitate a discussion. This study aims to contribute to the development of a framework for analysing the characteristics of classroom discussions and the different roles teachers can adopt in guiding a discussion on controversial issues. In addition, we investigated how the way teachers guide the discussion is related to the structure (...) and content features of the discussion. The framework was used to analyse five classroom discussions in secondary education. Our framework appeared to be useful for revealing differences in the structure and content features of the classroom discussions and in the way teachers guide the discussion. Jaap Mansfeld and Frans de Haas bring together in this volume a distinguished international team of ancient philosophers, presenting a systematic, chapter-by-chapter study of one of the key texts in Aristotle's science and metaphysics: the first book of On Generation and Corruption. In GC I Aristotle provides a general outline of physical processes such as generation and corruption, alteration, and growth, and inquires into their differences. He also discusses physical notions such as contact, action and passion, and mixture. These (...) notions are fundamental to Aristotle's physics and cosmology, and more specifically to his theory of the four elements and their transformations. Moreover, references to GC elsewhere in the Aristotelian corpus show that in GC I Aristotle is doing heavy conceptual groundwork for more refined applications of these notions in, for example, the psychology of perception and thought, and the study of animal generation and corruption. Ultimately, biology is the goal of the series of enquiries in which GC I demands a position of its own immediately after the Physics. The contributors deal with questions of structure and text constitution and provide thought-provoking discussions of each chapter of GC I. New approaches to the issues of how to understand first matter, and how to evaluate Aristotle's notion of mixture are given ample space. Vardanyan's theorem states that the set of PA-valid principles of Quantified Modal Logic, QML, is complete Π0 2. We generalize this result to a wide class of theories. The crucial step in the generalization is avoiding the use of Tennenbaum's Theorem.

Biobanks correspond to different situations: research and technological development, medical diagnosis or therapeutic activities. Their status is not clearly defined. We aimed to investigate human biobanking in Europe, particularly in relation to organisational, economic and ethical issues in various national contexts. Data from a survey in six EU countries were collected as part of a European Research Project examining human and non-human biobanking. A total of 147 institutions concerned with biobanking of human samples and data were investigated by questionnaires and (...) interviews. Most institutions surveyed belong to the public or private non-profit-making sectors, which have a key role in biobanking. This activity is increasing in all countries because few samples are discarded and genetic research is proliferating. Collections vary in size, many being small and only a few very large. Their purpose is often research, or research and healthcare, mostly in the context of disease studies. A specific budget is very rarely allocated to biobanking and costs are not often evaluated. Samples are usually provided free of charge and gifts and exchanges are the common rule. Good practice guidelines are generally followed and quality controls are performed but quality procedures are not always clearly explained. Associated data are usually computerised. Biobankers generally favour centralisation of data rather than of samples. Legal and ethical harmonisation within Europe is considered likely to facilitate international collaboration. We propose a series of recommendations and suggestions arising from the EUROGENBANK project. (shrink)

This article describes how the facts in social reality take an intermediate position between objective facts and purely subjective ‘facts’. In turn, these social facts can be subdivided into constructivist and non-constructivist facts. The defining difference is that non-constructivist facts are completely determined by an approximate consensus between the members of a social group, while constructivist facts are founded in such a consensus but can nevertheless be questioned. Ought fact are such constructivist facts. Because they are founded in social reality, (...) a naturalistic theory of ought facts is attractive. Because constructivist facts are always open to questioning, we can explain why the facts in social reality may found ought facts but are nevertheless not the final word about them. (shrink)

A good place to start in assessing a theory of truth is to ask whether the theory under discussion is consistent with Aristotle’s commonsensical definition of truth from Metaphysics 4: “What is false says of that which is that it is not, or of that which is not that it is; and what is true says of that which is that it is, or of that which is not that it is not.”1 Philosophers of a realist bent will be delighted (...) to see that Anselm unambiguously adopts the Aristotelian commonplace. A statement is true, he says, “when it signifies that what‐is is.”2 But the theory of truth that Anselm builds on this observation is one that would surely have confounded Aristotle. For no matter what the topic, Anselm’s thinking always eagerly returns to God; and the unchallenged centrality of God in Anselm’s philosophical explorations is nowhere more in evidence than in his account of truth. Indeed, we see in the student’s opening question in De veritate that the entire discussion has God as its origin and its aim: “Since we believe that God is truth, and we say that truth is in many other things, I would like to know whether, wherever truth is said to be, we must acknowledge that God is that truth.”3 The student then reminds Anselm that in the Monologion he had argued from the truth of statements to an eternal Supreme Truth. Does this not commit Anselm (the student seems to be asking) to holding that God himself is somehow the truth of true statements? But what definition of truth could make sense of such an odd claim? Anselm is happy to take up the challenge of showing that his description of God as “Supreme Truth” is no mere metaphor, but the expression of the deepest insight into the nature of truth. An account of truth is just theology under a different name. This first distinctive characteristic of Anselm’s theory, the centrality of God as Supreme Truth, helps account for a second distinctive characteristic: its strong insistence on the unity of truth. According to Anselm's official definition, freedom of choice is ‘the power to preserve rectitude of will for the sake of that rectitude itself.’ From the point of view of contemporary metaphysics, this is one of the most unhelpful definitions imaginable. Does such freedom require alternative possibilities, for example? Is it compatible with causal determination? Is the exercise of such freedom a necessary and sufficient condition for moral responsibility? The definition sheds no light on these questions.And so we need to move (...) on from Anselm's definition to Anselm's account of freedom. Here, though, we encounter the opposite problem. Where Anselm's definition seems not to answer these questions at all, Anselm's account seems to answer all these questions, sometimes with a yes and sometimes with a no. Consider the question about alternative possibilities. In De libertate arbitrii, Anselm seems clearly to deny that freedom involves alternative possibilities. In the "Doxographi Graeci" the preferred short heading of Aët. 2.31 (Greek text below, p. 28) is 'On Distances', though ps.Plutarch has a long heading. This chapter is about the distances of the sun and moon from each other and from the earth (lemmas 1 to 3, in both ps.Plutarch and Stobaeus), and of the real or apparent shape of the heaven relative to its distance from the earth (lemmas 4 and 5, Stobaeus only). Parallels from Ioann. Lydus and Theodoret (...) for what is in ps.Plutarch are given by Diels in apparatu. To the best of my knowledge it has not been noticed that a version of ps.Plutarch's text is preserved in a scholium on the "Almagest", which constitutes our earliest evidence for the text. The correctness of Diels' reconstruction is questionable. Though certainty, naturally, is beyond our reach it is quite possible that these two sets of lemmas represent two distinct Aëtian (or proto-Aëtian) chapters. These may have been coalesced by Stobaeus (or Aëtius), while ps.Plutarch abridged the second (or the two final lemmas) away. These considerations necessitate an inquiry into the parallels that are available, including material from an introduction to Aratus. The vexing question of short versus long(er) chapter headings is also relevant in this context. Furthermore, the contrasting views regarding cosmic distances are not only a feature of the Placita literature with a distant origin in Aristotle, but also, apparently, of the commentary literature on Plato's "Timaeus". Arguably in a passage in Plutarch's "De facie" these two traditions intersect. Finally, a case can be made out for Eudemus not Theophrastus as an intermediary source of Presocratic astronomical data in the Placita. (shrink)
